
On Friday Night, Department of Justice’s special counsel Jack Smith filed an appeal to the federal charge who is overseeing the case relating to former President Donald Trump’s impeachment, calling for a protective order to be issued for the evidence.
Trump had taken to Truth Social earlier that day to argue that he was going to be going after anyone who was coming after him. This post has been blasted by many critics of former President Trump who have argued that his tactics could be labeled as “witness intimidation” or “chilling.”
Smith, in the appeal, claimed that a strict order needed to be put in place so that Trump would be blocked from disclosing to the public evidence and documents from the discovery process. He argued further that these restrictions are incredibly important because of Trump’s previous statements against judges, prosecutors, and witnesses in connection to other legal cases he is facing.
He pointed out that should Trump start to issue public posts that include the evidence he gets from the discovery process then the witnesses may be harmed by a “chilling effect,” which could also have an effect on this case.
Prosecutors have claimed that they have tried to come up with an agreement regarding protective orders with the legal team representing the former President, but that so far, these attempts have not gone anywhere.
Smith, in the filing, claimed that the government wanted to provide access to the discovery as swiftly as possible, including certain pieces of evidence that the defendant was not yet allowed access to.
