Supreme Court’s Immunity Ruling Raises New Military Question

(FeaturedNews.com) – The most recent ruling by the U.S. Supreme Court regarding presidential immunity has resulted in a lot of questions about presidential military commands and what prosecution options are available if those orders are found to be in violation of U.S. or international laws. 

The commander in chief has been granted immunity from criminal prosecution which could allow him more space to issue controversial military decisions. The latest decision of the highest court has led to a lot of concerns regarding Trump, especially considering his promise to exact revenge if he manages to win back the White House in November. 

According to experts, the ruling does not provide immunity protections for any of the service members and commanders who carry out the orders given to them by the president. 

New England School of Law in Boston professor of law Victor Hansen noted that service members are required to adhere to legal standards even in cases where the president does not. However, the recent ruling completely flips this dynamic, as the subordinates will bear all the responsibility despite lacking authority. Hansen, who had served in the U.S. Army as a military lawyer for 20 years, pointed out that the person who is now at the top would be granted complete authority without having any of the responsibility. 

He concluded his assessment by arguing that the ruling is “absurd” and would cause damage.
