California Built a ‘Gay Certification’ System for Public Contracts

California’s Public Utilities Commission (CPUC) runs a supplier diversity program that sets spending targets for large utility companies — those earning more than $25 million a year. The targets include 15% for minority-owned firms, 5% for women-owned firms, 1.5% for disabled veteran-owned firms, and 1.5% for certified LGBT-owned businesses. If the largest utilities hit that 1.5% mark, the math adds up to roughly $633 million flowing to LGBT-certified companies.

California passed the law behind this program back in 2014. It was the first state in the country to require utilities to include certified LGBT Business Enterprises in their contracting process. The National LGBT Chamber of Commerce — known as the National Gay and Lesbian Chamber of Commerce (NGLCC) — serves as the exclusive body that reviews and approves these certifications. The CPUC officially adopted the NGLCC’s certification standards as part of the program.

What Businesses Must Prove to Get Certified

The certification process is detailed and deeply personal. To qualify, a business must be at least 51% owned, managed, and controlled by an LGBT person who is a U.S. citizen or permanent resident. But proving that identity to the government’s satisfaction requires real documentation. Applicants can submit a marriage license showing a same-sex union, three personal reference letters written on company letterhead from people who can vouch for the owner’s sexual orientation, or a letter from a recognized LGBT organization confirming the owner’s identity.

Other accepted documents include news articles that publicly identify the owner as LGBT, records of same-sex parenting efforts such as adoption or in-vitro fertilization, or a physician’s letter showing evidence of gender transition surgery or procedures. The CPUC’s own certification guidance lists these requirements clearly. Anyone who lies on the application faces a fine of up to $5,000 and up to one year in jail.

Critics Call the Program Illegal Favoritism

The program has drawn sharp criticism from legal experts and conservatives who say the government has no business handing out contract advantages based on who someone is attracted to. The CPUC calls its targets “goals” rather than “quotas,” but the agency still requires utilities to file detailed annual reports, submit improvement plans, and explain in writing why they fell short. That is a lot of pressure for something labeled voluntary.

The core problem is simple: taxpayer-funded contracts are supposed to go to the most qualified bidder at the best price. When the government ties contract access to personal identity — and then demands documents proving that identity — it crosses a line. Every dollar steered toward a business because of its owner’s sexual orientation is a dollar that may not be going to the best or most affordable vendor. California ratepayers and taxpayers deserve better than a procurement system built around identity politics.
