Court Hands Major Blow to Trump Again

(FeaturedNews.com) – On Tuesday, an appeals court in New York denied former President Donald Trump’s attempt to delay the hush money criminal case. Trump had previously tried to fight against the gag order that Judge Juan Merchan had imposed on him in connection to this case. 

The gag order blocked Trump from attacking any prosecutors, court staff, witnesses, and Merchan’s family. However, it does not block Trump from attacking either the judge or Manhattan District Attorney Alvin Bragg (D).

On Tuesday, Trump’s lawyers appeared for an emergency hearing before Justice Cynthia Kern where they had argued that it was unconstitutional for Trump to ban public statements regarding these individuals and that this gag order was taking away Trump’s right to free speech. As they pointed out this was happening while he was running for the White House and trying to defend himself against these cases. 

Emil Bove, Trump’s lawyer, argued that the harms caused by this gag order were “irreparable.” However, state prosecutors have opposed Trump’s comments threatening the “public interest” in providing protection for the trial’s integrity. 

Manhattan District Attorney’s office appellate chief Steven Wu had argued that this was not a “political debate” but rather that Trump’s statements had been insults. 

Trump’s legal team had been pushing for an indefinite pause of the trial, which is currently scheduled to start on April 15. Kern however declined the emergency stay during the appeal process, which means that the trial date continued to be the same. 

The lawsuit filed against the gag order is currently under seal with the documents remaining private.
